Portugal's firefighter welfare fund goes from 3% to 5% (though the money only lands with the 2027 budget)
Law 39/2026 was published on Monday: a bigger social protection fund, legal aid for acts carried out on duty, extra exam sittings without a minimum service requirement and tuition fees refunded. It takes effect with the next state budget.
Law 39/2026 appeared in Portugal’s official gazette on Monday, strengthening the rights and benefits of the country’s firefighters. It amends two texts: Decree-Law 241/2007, which sets the legal regime for firefighters on the mainland, and Law 94/2015, which governs how the humanitarian associations are financed — the bodies that in practice own most of the country’s fire brigades.
The change with real money behind it is to the Firefighter Social Protection Fund. The share transferred to it rises from 3% to 5%, widening the cushion that covers firefighters and their families in cases of accident, illness or death on duty.
Studying no longer requires seniority
A good part of the rest of the law is about school. Firefighters in professional, mixed or volunteer corps can now request up to five additional exam sittings per academic year, capped at two per subject, and the requirement of at least one year of effective service before qualifying has been scrapped. Anyone who has worked shifts and then tried to reach an exam hall knows what that is worth.
That same minimum service period also disappears for officers, active firefighters and those in command posts seeking reimbursement of tuition and enrolment fees paid in secondary and higher education.
There is a third strand, less discussed and probably the most delicate: the law provides legal aid in proceedings where a firefighter is claimant or defendant over acts carried out in the course of duty. It answers a long-standing complaint from people who make decisions in seconds and may be asked to justify them in court years later.
Passed with abstentions, paid in 2027
The bill came from the communist PCP and cleared parliament with abstentions from PSD, CDS and IL. In the same session, MPs rejected the early-retirement regime for the profession, which was the most expensive item on the list.
None of it applies yet. The law states that it produces effects with the State Budget Law following its publication, which pushes the bill into the 2027 budget — the same document where the Socialists have already drawn their red lines. It is a pattern of this legislative summer, much like the risk allowance for prison and rehabilitation staff.
